Once the Substitution of Trustee has been sent to record and we have received the
evidence of title, Nectar Projects Inc. will then schedule the publication dates and
the sale. When the notice of sale is prepared it is sent to an approved newspaper
for publication. This notice will be published in the legal notices section in
accordance with the terms and conditions of the Deed of Trust and/or the code of
the Commonwealth of Virginia section 55-59.2. Usually this is either once a week
for two consecutive weeks or five times in any order provided that the property is
in a County contiguous to a City therein. The Trustee's Sale can not be set less
than eight days after the first publication and it can not be more than 30 days after
the last publication.
On Veterans Administration insured loans, publication will normally begin 15 to 25
days after the order is received. The foreclosure sale will normally be completed
within 35-45 days after the referral date. The VA requires the VA-567 to be
submitted 30 days prior to the proposed foreclosure sale. On Federal Housing
Administration loans, publication will normally begin 15-25 days after the order is
received. The foreclosure sale on VA and FHS properties will normally be
completed within 45-60 days after the referral date.
On PMI and uninsured loans, publication will normally begin 10-20 days after the
order is received. The sale will be set as soon as publication requirements allow.
